Addit — Terms of Use

Addit is a listening interface for music you already keep in your own cloud storage. It hosts nothing, sells nothing, and stores no music of ours. What you can play, and who you can share it with, is decided by your cloud provider and by whatever rights you hold in the files themselves.

These terms are an agreement between you and Hollowpoint Collective LLC, an Arizona limited liability company ("we", "us"), which makes and publishes Addit. They cover the Addit iOS app and the pages at hollowpoint.tv/addit. By using Addit you accept them. If you do not, don't use the app.

What Addit is

Addit reads audio files from cloud accounts you connect — Google Drive or Microsoft OneDrive — and from your iPhone's own storage, and plays them. A folder is treated as an album; the audio files directly inside it are its tracks. The app talks to those providers directly from your device.

We do not host, store, stream, index, transcode or distribute any music. There is no Addit catalogue and no Addit library in the cloud. Every file you hear is one you or someone you know already put in storage you or they control.

Your licence to use the app

We grant you a personal, non-exclusive, non-transferable, revocable licence to use Addit on devices you own or control, for as long as these terms are kept. You may not sell, rent, sublicense or redistribute the app, or attempt to extract its source beyond what applicable law allows you to do regardless of this clause.

Addit is distributed through the App Store, so Apple's Licensed Application End User Licence Agreement also applies. Where it and these terms conflict on a point it covers, Apple's terms win. Apple is not a party to this agreement, has no obligation to support Addit, and is a third-party beneficiary entitled to enforce it against you.

Your content, and copyright

This is the part that matters most, so it is stated plainly.

You are responsible for the files you add to Addit, play through it, and share with it. By using the app you confirm that for each file you either own the rights, hold a licence covering what you are doing with it, or are otherwise permitted by law to do it. Ripping your own records for your own listening is not the same thing as sending copies to other people, and only you are in a position to know which one you are doing.

We have no way to see your files. Addit has no server, we hold no copy of your library, and nothing you play is reported to us. That is a deliberate privacy property — described in the privacy policy — and its consequence is that we cannot vet what you use the app for. The obligation is genuinely yours.

Sharing and access

Addit's share links do not grant access to anything. A link is a pointer to a folder in your cloud storage; whether the person you send it to can open it is decided entirely by the sharing permissions on that folder, enforced by Google or Microsoft, exactly as if you had sent them a link from those providers' own apps. Addit can ask a provider to change a folder's permissions when you tell it to, and the provider decides whether you are allowed.

It follows that sharing an album is a real act of distribution when the folder is open to others, and it is governed by the rights you hold in the files. Setting a folder to "anyone with the link" is a decision to publish whatever is in it.

Copyright complaints

We host no music, so there is nothing of that kind for us to take down. The one thing this website does serve on your behalf is link preview cards: when an album or song link is pasted somewhere, our server renders a page carrying that album's title, artist and — where the folder's own permissions already allow it — its cover image, so the link shows a card instead of a bare URL.

If you hold rights in material appearing in one of those preview cards and believe it is there without authorisation, send a notice to our designated agent below, with the link, the material concerned and enough detail to identify your rights. We will remove or disable the preview promptly. Note that this affects only the preview card on our domain — the underlying folder lives in someone's Google or Microsoft account, and only that provider can act on it.

Third-party services

Google Drive, Microsoft OneDrive and the App Store are run by their respective companies, not by us. Your use of them is governed by their terms, and they can change or withdraw them at any time in ways that affect what Addit can do. Addit is not affiliated with, endorsed by, or sponsored by Google LLC, Microsoft Corporation or Apple Inc. Their names and marks belong to them and are used only to say which services the app connects to.

Availability, and no warranty

Addit is free. There is no subscription, no paid tier and no advertising, and there is correspondingly no promise that it will keep working, stay available, or continue to exist. Features may change or be removed. A cloud provider may change an API and break something overnight.

To the fullest extent the law allows, Addit and this website are provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, and uninterrupted or error-free operation.

Keep your own backups. Addit can move, copy, upload and delete files in your cloud storage when you ask it to, and a bug, a failed transfer or a provider outage could lose data. Do not let the only copy of anything you care about exist in a place an app can delete.

Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential damages, nor for lost data, lost files, lost music or lost profits, arising from your use of Addit. Because the app is provided free of charge, our total liability to you for any claim is limited to the greater of the amount you paid us for Addit (which is nothing) and the minimum the law does not permit us to exclude.

Nothing here limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud. Some jurisdictions do not allow certain exclusions, in which case those exclusions do not apply to you and the rest still stands.

Age

Addit is not directed at children under 13, and you must be old enough to hold the cloud accounts you connect.

Ending it

You can stop at any time by deleting the app; that removes everything it kept on your device, and disconnecting an account from the in-app switcher removes that account's tokens and cached audio. We may suspend or end your access to the website's services if these terms are broken. Nothing we do touches the files in your own cloud storage — those are yours and stay where they are.

Changes

If these terms change materially, the effective date above will change and the revision will be posted at this address.

Governing law

These terms are governed by the laws of the State of Arizona, United States, without regard to its conflict-of-laws rules, and disputes arising from them belong in the state or federal courts sitting in Arizona.

If you live somewhere whose consumer-protection law gives you rights you cannot sign away, you keep them. This clause does not remove protections your local law grants you, and it does not oblige you to bring a claim in a distant court where that law says you may bring it at home.
